Nigeria drops criminal case against Sir Sam Jonah and three others

Nigeria’s Attorney General has ordered the termination of criminal proceedings against Ghanaian businessman Sir Sam Jonah and three others, after finding that investigations linked to Jonah Capital Nigeria Limited and Houses for Africa Nigeria Limited failed to establish a prima facie case.

The dispute arose following a formal petition by Sir Sam Jonah to Ghana’s Foreign Affairs Minister, Samuel Okudzeto Ablakwa, dated December 13, 2025. The petition requested government intervention after the alleged unlawful seizure of his investments at Abuja’s River Park Estate by the Corporate Affairs Commission (CAC).

The AGF’s decision, communicated in official correspondence signed by the Director of Public Prosecutions, M.B. Abubakar, followed a thorough review of police files and investigations. It concluded that allegations of forgery, fraud, and related offences against Mr. Jonah, Mr. Kojo Ansah Mensah, Mr. Victor Quainoo, and Mr. Abu Arome could not be sustained.

Investigations by the Nigeria Police Force were found insufficient to meet the required standard of proof for criminal liability. “No prima facie case of forgery and other related offences… has been established against the aforementioned individuals,” the AGF stated regarding Charge No. CR/402/25.

The Attorney General also endorsed the findings of a Special Investigation Panel on Jonah Capital, Houses for Africa, and the River Park Estate, describing its report as “valid, comprehensive, and unbiased.” Conversely, the AGF criticized the IGP Monitoring Unit’s conclusions as “highly misleading,” noting that attempts to frame a commercial dispute as criminal violated Nigeria’s Administration of Criminal Justice Act, 2015.

The AGF also condemned a June 27, 2025 police press conference that publicly identified certain individuals as owners and managers of the River Park Estate without judicial determination, describing such pronouncements as exceeding lawful police authority.

Additionally, the AGF instructed the CAC to immediately reverse any administrative actions against the companies arising from the disputed police report and to avoid steps that could interfere with ongoing court proceedings.

Beyond ending the case against the four individuals, the Attorney General called for fresh investigations into allegations of criminal intimidation, assault, and property destruction at the River Park Estate, reportedly linked to directives from Paul Odili. The Nigeria Police Force was also instructed to ensure the safety of residents and allow peaceful enjoyment of the estate.
