Supreme Court adjourns Kpandai MP case ruling to January 28

The political future of the Kpandai constituency remains uncertain after the Supreme Court adjourned its ruling on a key legal challenge to January 28, 2026.

A five-member panel of the apex court, chaired by Justice Gabriel Pwamang, fixed the new date after listening to submissions from both parties in the case. The hearing attracted a strong showing of senior officials from the New Patriotic Party (NPP) and the National Democratic Congress (NDC), with several Members of Parliament present in solidarity as the fate of Kpandai MP Matthew Nyindam remains unresolved.

The case stems from a certiorari application filed by Mr Nyindam, the NPP Member of Parliament for Kpandai, who is seeking to overturn a November 2025 ruling by the Tamale High Court that annulled his 2024 election victory and ordered a fresh election within 30 days.

Mr Nyindam’s lawyers, led by Gary Nimako, argued that the election petition filed by the NDC’s candidate, Daniel Nsala Wakpal, was fundamentally flawed, having been submitted 32 days after the election results were gazetted, contrary to the 21-day limit stipulated under the 1992 Constitution. They contended that the High Court therefore lacked jurisdiction to hear the matter or to annul the election results.

The dispute began after the Tamale High Court, presided over by Justice Emmanuel Plange Brew, upheld allegations of widespread irregularities at about 41 polling stations. The court ruled that the anomalies were substantial enough to affect the final outcome, in which Mr Nyindam was declared winner with 27,647 votes, representing 53.47 per cent, against Mr Wakpal’s 24,213 votes, or 46.33 per cent.

Following the annulment, the Electoral Commission had scheduled a rerun for December 30, 2025. However, the Supreme Court granted a stay of execution on December 16, 2025, halting all preparations pending a determination of the jurisdictional issues raised.

Reacting to the adjournment, the Member of Parliament for South Dayi and Majority Chief Whip, Rockson Nelson Dafeamakpor, said the NDC remains confident of securing victory.
