Akosua Serwaah appeals ruling recognising two spouses of Daddy Lumba

Akosua Serwaah has filed an appeal at the Court of Appeal in Kumasi against a High Court ruling that recognised both her and Priscilla Ofori, popularly known as Odo Broni, as the lawful surviving spouses of the late highlife legend Charles Kwadwo Fosu, known as Daddy Lumba.

In her notice of appeal, Ms Serwaah is challenging the entire judgment of the Kumasi High Court, arguing that the trial court erred in rejecting and declaring inadmissible a marriage certificate she presented in support of her claim.

She further contends that the High Court misapplied the Evidence Act, 1975 (NRCD 323), when it ruled that she had failed to meet the legal requirements for admitting the marriage certificate into evidence.

Ms Serwaah is therefore asking the Court of Appeal to overturn the High Court’s decision and to declare her as the sole lawful surviving spouse of the late musician.

The appeal follows a judgment delivered on November 28, 2025, by the Kumasi High Court, presided over by Justice Dr Dorinda Smith Arthur, which dismissed Ms Serwaah’s suit seeking to be declared Daddy Lumba’s only surviving spouse.

The High Court held that Ms Serwaah failed to prove that she was married to the deceased under the Marriage Ordinance in a manner that would exclude other spouses. The court found that the evidence showed Daddy Lumba married Akosua Serwaah under customary law, which is potentially polygamous, making his subsequent marriage to Priscilla Ofori, also known as Odo Broni, valid under Ghanaian law.

In its final ruling, the court recognised both Akosua Serwaah and Priscilla Ofori as the lawful surviving spouses of the late music icon.
