Joana Quaye, the ex-wife of businessman Richard Nii Armah Quaye (RNQA), has filed an appeal against a High Court ruling that dissolved their marriage and distributed properties acquired during the union.
The appeal, filed on her behalf by former Attorney-General and Minister of Justice Godfred Yeboah Dame, seeks to have the Court of Appeal set aside the final orders of the High Court. The lower court’s decision was delivered by Justice Dorgu, who sat as an Additional High Court Judge of the Family Court.
Grounds for Appeal
According to the Notice of Appeal filed by Mr. Dame, the ex-wife argues that the trial judge committed a fundamental error of law.
“The learned trial judge committed a fundamental error of law by failing to recognise that all the immovable and movable properties claimed by respondent, including shares in companies, were acquired during the subsistence of the marriage and thus constitute marital property to be distributed equitably between the parties,” the appeal states.
Lawyers for Ms. Quaye are asking the Court of Appeal to overturn the High Court’s decision on this basis.
