A Land Division of the Accra High Court has issued a perpetual injunction restraining a retired military officer and some serving soldiers from entering or interfering with a 2.40-acre parcel of land at Tse Addo in Accra.
The court, presided over by Justice Kwame Gyamfi Osei, ruled in favour of plaintiff Adolf Tetteh Adjei, declaring him the rightful owner of the disputed property.
The defendant, Squadron Leader John William Quainoo (retired), who currently works with Africa World Airlines, was found to have trespassed on the land. The court noted that the retired officer failed to provide any evidence to support his claim that the plaintiff’s grantors lacked the capacity to transfer ownership.
“It is clear from the evidence that the defendant interfered with the disputed land. He has since failed to justify his intentions on the plaintiff’s land,” the judge held.
In addition to the perpetual injunction against Sqn Ldr Quainoo (retd), his servants, agents, and any person claiming through him, the court awarded a cost of GH¢60,000 against the defendant.
The court further imposed punitive damages of GH¢100,000 against the retired squadron leader for using soldiers to trespass on the land even after judgment had been delivered.
Mr Adjei had sued for trespass, recovery of possession, general damages, and legal fees amounting to 10 percent of the value of the land.
The judgment, delivered on January 27, 2026, also granted the plaintiff possession of the property.
